1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the MyD.D. Rideshare website, mobile application, and related services (collectively, the “Service”), operated by Mars Jr LLC, doing business as MyD.D. Rideshare (“Company,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you may not use the Service.
2. Description of Services
MyD.D. Rideshare is a technology platform that connects independent drivers with riders seeking transportation services. The Company does not provide transportation services directly. Drivers operate as independent contractors and are not employees, agents, or representatives of Mars Jr LLC.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age (21 for drivers)
- Possess the legal authority to enter into binding agreements
- Comply with all applicable laws and regulations
Drivers must meet additional eligibility requirements outlined in the Driver Terms.
4. User Accounts
You may be required to create an account to access certain features. You agree to:
- Provide accurate and complete information
- Maintain the security of your login credentials
- Accept responsibility for all activity under your account
The Company reserves the right to suspend or terminate accounts for violations of these Terms.
5. Payments and Fees
All payments are processed securely through third-party payment providers, including Stripe.
By using the Service, you agree that:
- Fare estimates are subject to change based on distance, time, and applicable fees
- Cancellation fees may apply
- You authorize the Company to charge your selected payment method
The Company is not responsible for payment processing errors caused by third-party providers.
6. Cancellations and Refunds
Cancellation policies, including applicable fees, are displayed within the app or website. Refund requests must be submitted to:
Refunds are reviewed on a case-by-case basis.
7. User Conduct
You agree not to:
- Use the Service for unlawful purposes
- Harass, threaten, or harm drivers or riders
- Interfere with the operation of the platform
- Provide false information
Violation may result in permanent removal from the platform.
8. Independent Contractor Status
Drivers using MyD.D. Rideshare are independent contractors. Nothing in these Terms creates an employer-employee relationship between Mars Jr LLC and drivers.
9. Safety Disclaimer
While we implement safety measures, Mars Jr LLC does not guarantee the conduct of users. Riders and drivers use the Service at their own risk.
10. Limitation of Liability
To the fullest extent permitted by law, Mars Jr LLC shall not be liable for:
- Indirect or incidental damages
- Personal injury resulting from independent contractor actions
- Loss of profits, data, or goodwill
Our total liability shall not exceed the amount paid by you for the ride giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Mars Jr LLC from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
12. Termination
We reserve the right to suspend or terminate access to the Service at our discretion for violations of these Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.
