1. Agreement to Arbitrate

By using the MyD.D. Rideshare platform (including as a Rider or Driver), you agree that any dispute, claim, or controversy arising out of or relating to:

• Your use of the platform
• Transportation services arranged through the platform
• This Agreement
• Any payments, fees, or transactions
• Any injury, loss, or damages

shall be resolved exclusively through final and binding arbitration, except as otherwise stated below.

You waive your right to bring claims in court before a judge or jury.

2. Class Action Waiver

You agree that:

• All disputes must be brought on an individual basis.
• You waive the right to participate in a class action, collective action, consolidated action, or representative proceeding.
• The arbitrator may not consolidate multiple parties’ claims.

This class action waiver is a material and essential part of this Agreement.

3. Arbitration Procedure

Arbitration shall be:

• Conducted in the State of South Carolina
• Governed by the Federal Arbitration Act (FAA)
• Administered by a mutually agreed arbitration provider

The arbitrator shall have exclusive authority to resolve:

• Questions regarding enforceability
• Scope of arbitration
• Validity of this Agreement

The arbitrator’s decision shall be final and binding and may be entered as judgment in any court of competent jurisdiction.

4. Informal Dispute Resolution Requirement

Before initiating arbitration, the disputing party must:

1. Allow thirty (30) days for informal resolution.

No arbitration may begin until this 30-day period has passed.

5. Exceptions to Arbitration

Either party may bring claims in small claims court if:

• The claim qualifies under applicable law
• The claim remains on an individual basis

Injunctive relief related to intellectual property violations may be sought in court.

6. Severability

If any portion of this Arbitration Agreement is found unenforceable:

• The remainder shall remain in effect.
• If the class action waiver is found unenforceable, the entire arbitration provision shall be void.

7. Opt-Out Option

Users may opt out of arbitration by sending written notice within thirty (30) days of account creation to:

Failure to opt out within this period constitutes acceptance.

8. Survival

This Arbitration Agreement survives:

• Termination of your account
• Completion of services
• Any dispute resolution
